1. Appeal to the Canadian International Trade Tribunal, under the Special Import Measures Act, Levolor Home Fashions Canada v. President of the Canada Border Services Agency. Appeal No.: AP-2011-015

Goods in Issue: Certain aluminum extrusions for use with venetian blinds

Issue: Whether the goods in issue have a powder coat finish which is certified to meet the American Architectural Manufacturers Association AAMA 2603 standard and are therefore excluded from the Tribunal’s findings in Inquiry No. NQ-2008-003.

Issue: Whether the goods in issue are properly classified in heading No. 85.19 as sound reproducing apparatus or, in the alternative, in heading No. 92.08 as decoy calls of all kinds, as determined by the President of the Canada Border Services Agency, or should be classified in heading No. 85.31 as electric sound signalling apparatus, other than those of heading 85.12 or 85.30, as claimed by Maurice Sporting Goods Distributor Inc.

Goods in Issue: Certain aluminum parts and products.

Issue: Whether the goods in issue are goods of the same description as the goods to which the Tribunal’s findings in Inquiry No. NQ-2008-003 apply and whether the President of the Canada Border Services Agency improperly relied upon “zeroing” to establish the quantum of anti-dumping duties.
